Fire safety order affects most business premises

The GA's Health and Safety at Work advisor John Revington has warned that the biggest change in fire safety legislation has now come into force and the GA's insurance broker, T.H. March, are stressing the importance of complying with the new regulations to be covered by insurance.

The Regulatory Reform (Fire Safety) Order 2005 is intended to consolidate and simplify existing rules and affects the majority of business premises in England and Wales.

It covers general fire precautions and other fire safety duties needed to protect people in the case of fire in and around premises.

The order means that businesses themselves must take responsibility for carrying out fire risk assessments on their premises.

Fire certificates will no longer be issued by Fire authorities. Failure to comply with any duty imposed by the Order or any enforcement notice will be an offence, which upon conviction could involve either a fine or up to two years in prison.

Every business premises will be required to have a designated responsible person who, amongst other duties, must conduct a fire risk assessment. If a business is licensed or employs five or more people the assessment must be documented.
